What are the Penalties for Drug Crimes in Louisiana?

Louisiana has some of the harshest penalties in the country for drug crimes, including some of the harshest penalties for simple possession of marijuana. The state has a mandatory minimum sentence of 20 years for the possession of any amount of heroin, cocaine, or other Schedule I or II substances.

  • Simple possession of marijuana, including first-time offenders, carries a penalty of up to six months in jail and a $500 fine.
  • Additionally, Louisiana has mandatory minimum sentences for the distribution of certain types of drugs. The distribution of any amount of a Schedule I or Schedule II substance carries a minimum sentence of 10 years, while the distribution of any amount of heroin carries a minimum sentence of 20 years.

The penalties for distribution of other drugs vary depending on the type of drug and the amount in question. The penalties for distribution of marijuana are less severe, with a maximum sentence of five years in prison and a $50,000 fine. The penalties for distribution of Schedule III drugs are less severe than those for Schedule I or II drugs, with a maximum prison sentence of 20 years and a $500,000 fine. The penalties for distribution of Schedule IV drugs are the least severe, with a maximum sentence of five years in prison and a $50,000 fine.

If you are convicted of a drug crime, you will also likely have to register as a sex offender. Louisiana has a lifetime sex offender registration requirement for the possession of any amount of marijuana, including first-time offenders. The state also has a lifetime registration requirement for the possession of any amount of Schedule I or II drugs, including heroin and cocaine. The only way to avoid registration as a sex offender is to complete a drug treatment program. Additionally, you will be unable to own a firearm or obtain a concealed carry permit in the state of Louisiana if you are convicted of a drug crime.
